A new nationwide analysis of workplace fatalities found that Wyoming, Alaska, and North Dakota have the highest rates of fatal occupational injuries per capita in the United States, according to a study released by personal injury firm Team Law. The New Jersey-based personal injury law firm examined fatal workplace incidents across all 50 states. The findings highlight nationwide workplace safety trends and identify the states with the highest and lowest rates of fatal occupational injuries.
The study analyzed federal workplace fatality data from the U.S. Bureau of Labor Statistics, calculating per capita rates to account for population differences between states. The methodology examined fatal occupational incidents across various industries, revealing significant disparities in workplace safety outcomes nationwide.
According to the analysis, states with economies heavily dependent on high-risk industries such as construction, agriculture, and natural resource extraction demonstrated notably higher fatality rates. Wyoming, Alaska, and North Dakota ranked among the states with the highest fatal occupational injury rates per capita, while states with service-based economies generally showed lower rates.

The study revealed that the construction and transportation sectors account for the largest share of workplace fatalities nationwide, followed by agriculture and manufacturing. Workplace safety compliance also emerged as a key factor distinguishing states with lower fatality rates, such as New Jersey, from those with higher rates. States with robust safety inspection programs and strong enforcement mechanisms consistently demonstrate better outcomes in preventing fatal workplace incidents.
The analysis also examined temporal trends, finding that while overall workplace fatality rates have declined over the past decade, certain industries and regions have seen less improvement than others. Rural states face particular challenges due to limited access to emergency medical services and the prevalence of high-risk occupations.
